By accessing, browsing, using, creating an account on, or placing an order through this website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, without limitation or qualification. 

If you do not agree to these Terms and Conditions, you must not access, browse, use, create an account on, or place an order through this website. 

Your continued use of the Website after any update to these Terms and Conditions constitutes your acceptance of the updated Terms and Conditions. 

You represent and warrant that you are at least the age of majority in your jurisdiction and have the legal capacity to enter into a binding agreement. 

Nothing in these Terms and Conditions limits, excludes, or modifies any mandatory rights or remedies that you may have under applicable consumer protection laws, including Québec’s Consumer Protection Act, where applicable. If any part of these Terms and Conditions conflicts with mandatory consumer protection laws, those laws will prevail to the extent of the conflict.

The website located at TransitAuto.ca (the “Website”) is owned and operated by Les Pièces d’Auto Transit Inc. (“Transit Auto”), located at 1100 rue Jean-Marchand, Lévis, Québec, Canada. 

Access to and use of the Website is subject to these Terms and Conditions and all applicable laws. 

By accessing or using the Website, you agree to be bound by these Terms and Conditions. If you do not agree, you must immediately discontinue use of the Website. 

Transit Auto reserves the right, at its sole discretion and without notice or liability, to restrict, suspend, or terminate access to the Website or any portion of it at any time, to the maximum extent permitted by applicable law. 

Transit Auto further reserves the right to refuse access to any user at any time and for any reason, including, but not limited to, violations of these Terms and Conditions, suspected misuse, abuse, or fraudulent activity. 

These Terms and Conditions govern your use of the Website and form the entire agreement between you and Transit Auto regarding such use, except for any additional terms, policies, notices, or agreements that apply to specific purchases, services, promotions, or Website features. 

 2. Ownership / Restriction on Use

This Website, including all content, data, product information, fitment information, compatibility information, pricing information, graphics, photographs, images, audio, video, software, source code, design elements, trademarks, service marks, trade names, logos, text, databases, and other materials made available on or through the Website (collectively, the “Content”), is owned by Transit Auto, its affiliates, suppliers, licensors, or other authorized third parties. 

The Content is protected by Canadian and international copyright, trademark, database, and other intellectual property laws. 

Subject to these Terms and Conditions, Transit Auto grants you a limited, revocable, non-exclusive, non-transferable licence to access and use the Website and its Content solely for your own personal, lawful, non-commercial shopping and informational purposes. 

Except as expressly permitted by Transit Auto in writing, you may not copy, reproduce, modify, adapt, translate, publish, post, transmit, distribute, display, perform, create derivative works from, scrape, extract, download in bulk, transfer, sell, resell, license, or otherwise exploit any Content from the Website. 

Without limiting the foregoing, you may not use any robot, spider, crawler, scraper, data-mining tool, automated process, artificial intelligence tool, or similar technology to access, copy, monitor, extract, collect, index, reproduce, or use any Content from the Website, including product data, pricing data, fitment data, compatibility data, inventory data, images, or descriptions. 

You may not use the Website or any Content to create, improve, train, support, or operate any competing product catalogue, marketplace, search tool, database, software, artificial intelligence model, or commercial service. 

You may download, print, or save limited portions of the Content solely for your own personal and non-commercial use, provided that you keep all copyright, trademark, and proprietary notices intact and do not modify the Content. 

Transit Auto reserves all rights not expressly granted in these Terms and Conditions. Any unauthorized use of the Website or Content may violate copyright, trademark, privacy, publicity, competition, and other laws and may result in legal action.

Transit Auto makes reasonable efforts to display product information accurately. However, to the maximum extent permitted by applicable law, Transit Auto does not guarantee that product descriptions, specifications, images, pricing, availability, compatibility information, fitment information, or other Content on the Website will always be accurate, complete, current, error-free, or suitable for your specific vehicle or intended use. 

Product images are provided for illustration purposes only. The product received may differ from the image displayed, including with respect to packaging, labels, colour, finish, design, included accessories, manufacturer updates, or other non-material differences. Colours and images may also vary depending on your device, screen, settings, and browser. 

Certain weights, dimensions, specifications, applications, compatibility information, and similar descriptions are approximate and are provided for convenience only. Product manufacturers, suppliers, or Transit Auto may update, replace, discontinue, modify, or revise products, specifications, packaging, part numbers, compatibility information, or availability at any time without notice. 

The inclusion of any product or service on the Website does not guarantee that the product or service is available, in stock, compatible with your vehicle, suitable for your intended use, or available at the displayed price at all times. 

Any compatibility tools, search filters, Year/Make/Model lookups, fitment notes, product recommendations, or similar features are provided for convenience only and do not constitute a guarantee of fitment, compatibility, performance, or suitability. 

Before purchasing or installing any product, you are responsible for verifying that the product is appropriate for your vehicle, including by confirming the part number, fitment notes, specifications, and, where appropriate, compatibility with your Vehicle Identification Number (VIN). 

Transit Auto reserves the right, at any time and without notice, to correct errors, update Content, change product information, modify specifications, change prices, limit quantities, discontinue products, or remove products from the Website, to the maximum extent permitted by applicable law. 

4. Use of Products

You are solely responsible for determining whether any product purchased from the Website may be lawfully purchased, possessed, installed, used, imported, exported, resold, or otherwise handled in your jurisdiction. 

By placing an order, you represent and warrant that the products ordered will be used only in a lawful manner and in compliance with all applicable local, municipal, provincial, territorial, federal, and international laws, rules, regulations, codes, standards, restrictions, and requirements. 

You are responsible for ensuring that any product purchased from Transit Auto is appropriate and lawful for your intended use, vehicle, application, location, and method of installation, including with respect to road-use requirements, emissions requirements, safety requirements, inspection requirements, warranty conditions, modified vehicles, off-road use, racing use, or commercial use, where applicable. 

Products must be installed, used, maintained, and handled in accordance with all applicable laws, manufacturer instructions, warnings, specifications, and recommended practices. Transit Auto is not responsible for any loss, damage, injury, cost, fine, penalty, inspection failure, warranty issue, vehicle issue, or legal consequence arising from unlawful use, improper selection, improper installation, misuse, abuse, modification, neglect, failure to follow instructions, or use of a product for an unintended or prohibited purpose. 

To the maximum extent permitted by applicable law, you assume all responsibility and risk arising from the selection, purchase, installation, possession, and use of any product purchased through the Website. 

5. Accuracy of Information, Pricing, Availability, and Orders

Transit Auto makes reasonable efforts to ensure that the information displayed on the Website is accurate, complete, and current. However, to the maximum extent permitted by applicable law, Transit Auto does not guarantee that any information on the Website, including product descriptions, specifications, images, compatibility information, fitment information, prices, promotions, availability, shipping information, delivery estimates, or other Content, will always be accurate, complete, current, or error-free. 

Products displayed on the Website may be unavailable, discontinued, incorrectly described, incorrectly priced, shown with incorrect images, listed with incorrect specifications, or subject to quantity limits, shipping restrictions, supplier changes, manufacturer changes, or other errors. 

Prices, promotions, product availability, shipping availability, sale periods, product selection, and product information may vary by sales channel, marketplace, geographic region, customer location, warehouse, supplier, or time of purchase. Transit Auto reserves the right, at any time and without notice, to correct errors, update information, change prices, modify availability, limit quantities, refuse service, refuse an order, cancel an order, or require additional verification before accepting or shipping an order, to the maximum extent permitted by applicable law. 

Where required by applicable law, Transit Auto will present required order information before the order is submitted, including merchant information, product information, applicable prices, taxes, shipping fees, delivery information, cancellation, return, exchange, or refund conditions, and any other applicable restrictions or conditions. Before submitting an order, you will have the opportunity to review the order and correct errors. 

Before submitting an order, you are responsible for reviewing all order details, including the products selected, quantities, billing information, shipping information, applicable taxes, shipping fees, and total amount payable. You are responsible for correcting any errors before submitting your order. 

An email confirmation or order acknowledgement does not constitute Transit Auto’s acceptance of an order and does not create an obligation to sell or ship any product. Transit Auto may accept or reject an order after reviewing product availability, payment information, shipping information, suspected errors, suspected fraud, or any other irregularity. 

Transit Auto reserves the right, at its sole discretion and to the maximum extent permitted by applicable law, to refuse, limit, modify, or cancel any order for any reason, including, but not limited to, errors in pricing, product information, availability, shipping information, taxes, fees, suspected fraud, unauthorized activity, misuse of the Website, irregular transactions, remote shipping destinations, commercially unreasonable freight charges, resale, redistribution, commercial arbitrage, unauthorized marketplace activity, abusive promotional use, inventory manipulation, or payment verification issues. Such decisions may be made at any time, including after an order confirmation has been sent. 

Transit Auto may also refuse, limit, modify, or cancel any order that appears to be placed for resale, redistribution, commercial arbitrage, unauthorized marketplace activity, abusive promotional use, inventory manipulation, or any other purpose inconsistent with ordinary personal or business use of the Website, to the maximum extent permitted by applicable law. 

If Transit Auto cancels an order after payment has been made, Transit Auto will refund the amount paid for the cancelled portion of the order in accordance with applicable law. To the maximum extent permitted by applicable law, such refund will be your sole remedy for the cancelled order. 

Transit Auto reserves the right to report, investigate, refuse, cancel, or pursue legal remedies against any person who places or attempts to place an order in an unlawful, unauthorized, abusive, misleading, irregular, or fraudulent manner, including by using a third party’s identity, payment information, account, address, or other information without authorization. 

Nothing in this section limits any mandatory rights or remedies that you may have under applicable consumer protection laws. 

6. Shipping Limitations

Transit Auto may arrange for products to be shipped using carriers, shipping methods, and delivery services selected by Transit Auto or made available through the Website. Transit Auto reserves the right to determine, change, restrict, or refuse any shipping method, carrier, destination, or delivery option, to the maximum extent permitted by applicable law. 

You are responsible for providing complete and accurate billing, shipping, contact, and delivery information at the time of purchase. Transit Auto is not responsible for delays, non-delivery, additional charges, losses, or other issues resulting from inaccurate, incomplete, outdated, or undeliverable information provided by you. 

Shipping options, delivery estimates, shipping fees, and availability may vary based on product type, product size, product weight, destination, carrier restrictions, warehouse location, inventory availability, remote-location surcharges, and other operational factors. Any delivery timeframe displayed on the Website, at checkout, or in an order confirmation is an estimate only and does not constitute a guarantee, unless expressly stated otherwise in writing by Transit Auto. 

Shipping fees may be estimated on product pages or during the shopping process and may vary based on the full order, product size, product weight, shipping destination, carrier availability, warehouse location, remote-area classification, and other operational factors. The final shipping fee, where applicable, will be displayed before you submit your order. 

Transit Auto may split an order into multiple shipments, ship products from different locations, or use different carriers for different products within the same order. Additional shipping restrictions may apply to oversized, overweight, hazardous, regulated, fragile, remote-location, or special-order products. 

Transit Auto reserves the right to cancel, refuse, or modify an order, in whole or in part, where the shipping address is incomplete, inaccurate, restricted, inaccessible, remote, commercially unreasonable to service, or subject to excessive freight costs, carrier limitations, or shipping restrictions. If an order is cancelled after payment has been made, Transit Auto will refund the amount paid for the cancelled portion of the order in accordance with applicable law. 

To the maximum extent permitted by applicable law, Transit Auto is not responsible for delays, delivery failures, losses, additional charges, or damages caused by carriers, customs authorities, weather, labour disruptions, supply chain disruptions, incorrect shipping information, failed delivery attempts, refusal of delivery, unclaimed packages, remote-location restrictions, or events outside Transit Auto’s reasonable control. 

7. Delivery, Non-Delivery, Damaged Shipments, and Cancellation Rights

Transit Auto will make reasonable efforts to ship products within the delivery timeframe communicated during the order process or in the order confirmation. Delivery dates and timeframes are estimates only and are not guaranteed, unless expressly stated otherwise in writing by Transit Auto. 

Transit Auto’s ability to deliver an order may depend on product availability, supplier availability, carrier availability, payment verification, address verification, weather, transportation conditions, operational constraints, and other factors outside Transit Auto’s reasonable control. 

You are responsible for ensuring that someone is available to receive the shipment where required, that the shipping address is accessible and accurate, and that any delivery instructions provided are complete and correct. To the maximum extent permitted by applicable law, Transit Auto is not responsible for failed delivery attempts, delivery delays, returned packages, refused packages, unclaimed packages, or additional costs caused by inaccurate information, unavailable recipients, carrier access restrictions, or circumstances outside Transit Auto’s reasonable control. 

You must inspect all products promptly upon delivery. If a shipment appears damaged, incomplete, incorrect, or missing items, you must notify Transit Auto as soon as possible and provide any information reasonably requested by Transit Auto, which may include photos, packaging, labels, proof of delivery, order information, or other details required to investigate the issue or submit a carrier claim. 

Transit Auto may, to the maximum extent permitted by applicable law, choose the appropriate remedy for delivery issues, including investigation, correction of the order, replacement, reshipment, refund, partial refund, store credit, or another remedy determined by Transit Auto. 

If a product cannot be delivered, is significantly delayed, or if required information was not provided as required by applicable consumer protection law, you may have cancellation, refund, chargeback, or other rights under applicable law. Nothing in these Terms and Conditions limits any mandatory cancellation, refund, chargeback, or other remedy available to you under applicable consumer protection laws. 

Except where required by applicable law or expressly stated otherwise in Transit Auto’s return policy, original shipping fees, handling fees, oversized-item fees, remote-area fees, and other delivery-related charges are not refundable when delivered products are returned for reasons not caused by Transit Auto. 

To the maximum extent permitted by applicable law, and except where a refund is required by applicable law, shipping fees, handling fees, special-order fees, oversized-item fees, remote-area fees, and other delivery-related charges may be non-refundable where an order is refused, unclaimed, returned due to customer error, cancelled after processing, or otherwise affected by circumstances not caused by Transit Auto. 

8. Account Registration and Security

Certain features of the Website may require you to create an account or provide account information, including a username, password, contact information, billing information, shipping information, or other information requested by Transit Auto. 

You agree to provide accurate, current, complete, and truthful information when creating an account, placing an order, or otherwise using the Website. You agree to promptly update your information if it changes. 

You are solely responsible for maintaining the confidentiality and security of your username, password, account credentials, and any device or email account used to access your Transit Auto account. 

To the maximum extent permitted by applicable law, you are responsible for all activity, orders, purchases, charges, instructions, changes, submissions, communications, and other actions that occur under your account or using your account credentials, whether or not authorized by you. 

You agree not to create an account using false, misleading, incomplete, or unauthorized information and not to impersonate any person or entity or use another person’s account, identity, payment information, address, or credentials without authorization. 

You agree to notify Transit Auto immediately if you suspect or become aware of any unauthorized access to your account, unauthorized use of your username or password, unauthorized order, payment issue, or other breach of security. 

Transit Auto may, at its sole discretion and to the maximum extent permitted by applicable law, require additional verification of your identity, account information, billing information, shipping information, payment information, or order details before accepting, processing, modifying, or shipping any order. 

Transit Auto reserves the right, at its sole discretion and without notice or liability, to refuse account registration, suspend or restrict access to an account, terminate an account, cancel or refuse orders, or require a password reset or additional verification if Transit Auto suspects inaccurate information, unauthorized access, misuse, fraud, abuse, security risk, violation of these Terms and Conditions, or any other irregular activity. 

Transit Auto is not responsible for any loss, damage, delay, cost, charge, or liability arising from your failure to maintain the confidentiality or security of your account credentials, except to the extent such responsibility cannot be excluded under applicable law. 

9. Permitted Use and Prohibited Website Use

You may use the Website only for lawful purposes and in accordance with these Terms and Conditions. 

You agree not to use the Website, its Content, systems, features, accounts, checkout, promotions, product information, pricing information, fitment information, or services in any way that is unlawful, unauthorized, abusive, fraudulent, misleading, harmful, disruptive, or inconsistent with these Terms and Conditions.

You agree not to introduce or transmit any virus, malware, worm, Trojan horse, logic bomb, harmful code, or other technology that may damage, interfere with, intercept, or expropriate any system, data, or personal information. 

Transit Auto reserves the right, at its sole discretion and to the maximum extent permitted by applicable law, to monitor use of the Website, investigate suspected misuse, restrict or block access, cancel or refuse orders, suspend or terminate accounts, remove content, report unlawful activity, and pursue any available legal or equitable remedy. 

Any unauthorized use of the Website or its Content may violate copyright, trademark, privacy, publicity, competition, consumer protection, cybersecurity, and other laws. 

10. Trademarks

You may not use any Transit Auto trademark, trade name, service mark, logo, domain name, trade dress, or confusingly similar mark in any manner that may cause confusion, imply sponsorship, endorsement, affiliation, authorization, or approval, or damage the reputation or goodwill of Transit Auto. 

Without limiting the foregoing, you may not use Transit Auto trademarks, trade names, logos, product information, or brand identifiers in advertising, search engine advertising, metatags, keywords, social media accounts, domain names, marketplace listings, product listings, comparison tools, databases, catalogues, or competing websites without Transit Auto’s prior written authorization. 

Third-party trademarks, trade names, product names, manufacturer names, part numbers, logos, or other identifiers may appear on the Website for product identification, compatibility, descriptive, resale, or informational purposes only. Their appearance does not imply that Transit Auto is affiliated with, sponsored by, endorsed by, or authorized by the applicable third-party owner, unless expressly stated. 

Transit Auto reserves the right to object to or take action against any unauthorized, misleading, infringing, abusive, or improper use of any trademark, trade name, service mark, logo, domain name, trade dress, product information, or brand identifier to the maximum extent permitted by applicable law.

You may not use links to bypass or interfere with the Website’s security features, checkout flow, account systems, cookie consent tools, access controls, technical restrictions, or any other functionality of the Website. 

Transit Auto reserves the right, at any time and in its sole discretion, to request or require that any link to the Website be removed. Upon receiving such a request, you must promptly remove the link and stop any related use of Transit Auto’s name, trademarks, Content, or Website materials.

You agree not to collect, harvest, store, or misuse information about other users, including email addresses or personal information, without authorization; create a false identity; impersonate another person or entity; misrepresent your affiliation with any person or entity; interfere with the Website; or attempt to access systems, accounts, networks, or data without authorization. 

Transit Auto may, but is not obligated to, monitor, moderate, edit, remove, block, or refuse any User Content or user activity at its sole discretion and without notice, to the maximum extent permitted by applicable law.

By submitting User Content to the Website, you grant Transit Auto a worldwide, non-exclusive, unrestricted, royalty-free, perpetual, irrevocable, transferable, and sublicensable right and licence to use, reproduce, modify, edit, publish, translate, create derivative works from, distribute, publicly perform, publicly display, and otherwise exploit the User Content, in whole or in part, in any format, media, or technology now known or later developed, for any commercial or non-commercial purpose, without compensation to you, to the maximum extent permitted by applicable law.

User Content represents the views and opinions of the person submitting it and does not necessarily reflect the views of Transit Auto. Transit Auto has no obligation to store, maintain, return, or make available any User Content and may delete or fail to store User Content without liability, to the maximum extent permitted by applicable law. 

14. User Generated Content

Transit Auto may, from time to time, identify content that you created and publicly posted on a third-party social media platform or other third-party platform (the “Contributor” and “User Generated Content”) and request permission to use that User Generated Content for advertising, marketing, promotional, e-commerce, website, social media, or other commercial or non-commercial purposes. 

When User Generated Content is selected by Transit Auto, Transit Auto may contact the Contributor through the platform on which the User Generated Content appears or by another available method. Transit Auto may ask the Contributor to respond using specified approval language, such as “I Agree,” or another consent method identified by Transit Auto. A direct response in the same message thread using the specified approval language will be deemed valid consent to use the identified User Generated Content in accordance with these Terms and Conditions. 

By providing consent, the Contributor grants Transit Auto a perpetual, non-exclusive, irrevocable, sublicensable, worldwide, royalty-free right and licence to use, reproduce, display, distribute, exhibit, modify, adapt, publish, translate, transmit, disclose, publicly perform, publicly display, and create derivative works from the User Generated Content and the Contributor’s name, username, handle, voice, image, picture, portrait, likeness, statements, captions, and biographical information as they appear in or relate to the User Generated Content, for any commercial or non-commercial purpose, including advertising, marketing, and promotion of Transit Auto and its products and services. 

Transit Auto has no obligation to use any User Generated Content or any rights granted by the Contributor. Transit Auto’s use of User Generated Content does not imply endorsement of, or affiliation with, the Contributor. 

The Contributor acknowledges that the Contributor is not entitled to compensation, approval rights, notice of use, royalties, or any other payment for Transit Auto’s use of the User Generated Content, unless Transit Auto expressly agrees otherwise in writing. 

The Contributor represents and warrants that the Contributor is at least 18 years old, owns or controls all rights in the User Generated Content, has obtained all required permissions from persons appearing in the User Generated Content, and has the full right and authority to grant the rights described in these Terms and Conditions. 

The Contributor agrees that the User Generated Content does not violate any third-party rights or applicable laws, does not contain harmful code, and is not unlawful, misleading, defamatory, obscene, offensive, discriminatory, infringing, or otherwise inappropriate. 

To the maximum extent permitted by applicable law, the Contributor agrees to indemnify, defend, and hold harmless Transit Auto, its directors, officers, employees, contractors, representatives, partners, affiliates, related companies, and service providers from and against any claim, demand, liability, loss, damage, cost, or expense, including reasonable legal fees, arising out of or related to the User Generated Content, the Contributor’s breach of these Terms and Conditions, or Transit Auto’s use of the User Generated Content in accordance with the rights granted by the Contributor. 

To the maximum extent permitted by applicable law, the Contributor waives any claims and moral rights or similar rights that the Contributor may have in connection with Transit Auto’s use of the User Generated Content. 

15. Customer Ratings and Reviews

Transit Auto may allow customers to submit ratings, reviews, comments, photos, videos, or other feedback relating to products or services. Transit Auto encourages honest, accurate, and respectful communication. 

By submitting a rating or review, you represent and warrant that you own or have used the product, that your submission is accurate and based on your genuine experience, and that you are not submitting the review for an improper, misleading, fraudulent, or unlawful purpose. 

You agree not to submit a review that is false, inaccurate, misleading, defamatory, offensive, abusive, discriminatory, infringing, unlawful, compensated by an unauthorized third party, submitted by an employee or relative of a manufacturer or competitor without disclosure, or that includes confidential information, personal information, contact information, links, viruses, malware, or other harmful code. 

Transit Auto is under no obligation to display, maintain, or publish any rating or review. Transit Auto may edit, reject, withhold, remove, condense, or delete any rating or review at its sole discretion, to the maximum extent permitted by applicable law. 

By submitting a rating or review, you grant Transit Auto a worldwide, non-exclusive, unrestricted, royalty-free, perpetual, irrevocable, transferable, and sublicensable right and licence to use, reproduce, modify, edit, publish, translate, distribute, publicly display, publicly perform, and otherwise exploit the review and related content in any format, media, or technology, for any commercial or non-commercial purpose, without compensation to you, to the maximum extent permitted by applicable law. 

You agree to indemnify, defend, and hold harmless Transit Auto, its directors, officers, employees, contractors, representatives, partners, affiliates, related companies, and third-party service providers from and against any claim, demand, liability, loss, damage, cost, or expense, including reasonable legal fees, arising from your rating, review, or related submission, or your violation of this section.

16. Third-Party Links

From time to time, the Website may contain links or references to websites, applications, platforms, content, products, services, or resources that are not owned, operated, or controlled by Transit Auto. 

All third-party links are provided solely as a convenience and for informational purposes. Transit Auto does not control, endorse, sponsor, approve, verify, or guarantee any third-party website, platform, content, product, service, statement, policy, or practice unless expressly stated in writing. 

If you access any third-party website or platform through a link on the Website, you do so entirely at your own risk. Third-party websites and platforms may have their own terms, privacy policies, security practices, cookies, fees, product information, and business practices. 

Transit Auto is not responsible or liable for any content, product, service, loss, damage, cost, claim, security issue, privacy issue, transaction, communication, or dispute arising from or related to any third-party website, platform, link, product, service, or resource, to the maximum extent permitted by applicable law. 

17. Inappropriate Material

You are prohibited from posting, transmitting, submitting, uploading, linking to, or otherwise making available any material that is unlawful, threatening, defamatory, misleading, fraudulent, obscene, abusive, harassing, hateful, discriminatory, offensive, infringing, harmful, or that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law. 

Transit Auto may take any action it deems necessary or appropriate to prevent, stop, or remedy a violation of this section, including removing material, blocking access, suspending or terminating accounts, refusing or cancelling orders, preserving records, reporting activity to authorities, and cooperating with law enforcement, regulatory authorities, court orders, subpoenas, or legal requests, to the maximum extent permitted by applicable law. 

Transit Auto is not responsible for monitoring all material posted or transmitted through the Website and assumes no liability for user-posted material, to the maximum extent permitted by applicable law. 

18. User Information and User Communications

Other than personal information handled in accordance with Transit Auto’s Privacy Policy, any material, information, suggestion, idea, concept, know-how, technique, question, comment, product review, feedback, or other communication that you transmit, submit, or post to the Website or to Transit Auto in any manner (collectively, “User Communications”) will be considered non-confidential and non-proprietary, to the maximum extent permitted by applicable law. 

Transit Auto and its affiliates, service providers, representatives, and designees may use, reproduce, disclose, publish, broadcast, transmit, develop, manufacture, market, and otherwise exploit User Communications for any commercial or non-commercial purpose, without compensation to you, to the maximum extent permitted by applicable law. 

Transit Auto is not obligated to use, return, review, maintain, acknowledge, or respond to any User Communications. Transit Auto may monitor, review, remove, or refuse any User Communications at its sole discretion. 

You are responsible for ensuring that your User Communications do not contain confidential information, trade secrets, personal information of another person, infringing material, or any content that you do not have the right to provide. 

19. Account Name and Password

You are required to have an account name and password for certain activities on the Website. We may cancel or suspend your account name and password at any time, at our discretion, without notice or liability to you or any other person. We are not under any obligation to verify the actual identity or authority of any person using the account name and password to access and use the Website. We may at any time require proof of the identity of any person seeking to access and use the Website, and may deny access if we are not satisfied with such proof.

You are fully responsible and liable for the security of your account name and password and for all use and misuse of them. You agree to notify us immediately of any unauthorized use of your account. Transit Auto assumes no responsibility and will not be liable for any damages arising from or related to unauthorized use of your account or your failure to keep your password secure.

From time to time, Transit Auto may offer, sponsor, or co-sponsor contests, sweepstakes, promotions, giveaways, or similar activities on or through the Website or other channels. 

Each contest or promotion may be governed by specific rules, eligibility requirements, deadlines, entry instructions, prize descriptions, restrictions, and other terms made available in connection with that contest or promotion. 

By participating in any contest or promotion, you agree to comply with these Terms and Conditions, the applicable contest or promotion rules, and all applicable laws. In the event of a conflict between these Terms and Conditions and the specific rules of a contest or promotion, the specific rules will govern that contest or promotion, unless otherwise stated. 

Transit Auto reserves the right, to the maximum extent permitted by applicable law, to cancel, modify, suspend, disqualify entries from, or refuse participation in any contest or promotion in cases of suspected fraud, technical issues, misuse, error, ineligibility, violation of the rules, or circumstances outside Transit Auto’s reasonable control. 

21. Disclaimers / Limitation of Liability

Your use of the Website is at your own risk. The Website, its Content, and any information, materials, tools, features, recommendations, or services made available on or through the Website are provided on an “as is” and “as available” basis, to the maximum extent permitted by applicable law. 

Transit Auto does not guarantee that the Website will be uninterrupted, secure, error-free, virus-free, current, accurate, complete, compatible with your systems, or available at any particular time or location. 

To the maximum extent permitted by applicable law, Transit Auto and its directors, officers, employees, contractors, partners, affiliates, suppliers, service providers, agents, successors, and assigns will not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, including loss of profits, loss of data, loss of business, loss of use, business interruption, replacement costs, labour costs, diagnostic costs, towing charges, rental vehicle costs, or other financial or commercial loss, arising out of or related to the Website, Content, products, services, orders, shipping, installation, use, inability to use, or any website linked to the Website, even if Transit Auto has been advised of the possibility of such damages. 

To the maximum extent permitted by applicable law, Transit Auto’s total cumulative liability arising out of or relating to the Website, Content, products, services, orders, or these Terms and Conditions will not exceed the amount paid by you for the specific product giving rise to the claim. 

If you are dissatisfied with the Website, Content, or these Terms and Conditions, your sole remedy with respect to the Website is to stop using the Website, subject to any mandatory rights or remedies that may apply under applicable law. 

Nothing in this section limits any liability, warranty, remedy, or right that cannot be excluded or limited under applicable law. 

22. Warranties

Nothing in these Terms and Conditions limits any mandatory legal warranty or other non-excludable rights that may apply under applicable consumer protection laws, including Québec’s Consumer Protection Act, where applicable. 

Transit Auto sells automotive replacement parts, including products sold under brands owned or controlled by Transit Auto. For products sold under a brand owned or controlled by Transit Auto, Transit Auto acts as the brand owner, warranty provider, and, where applicable, the party responsible for administering the applicable product warranty, subject to these Terms and Conditions, any written warranty terms provided with the product, and any mandatory warranty obligations that cannot be excluded under applicable law. 

For products sold under third-party brands, any manufacturer warranty, if available, is provided by the applicable third-party manufacturer and may be subject to that manufacturer’s own terms, limitations, exclusions, procedures, and requirements. Transit Auto may assist with warranty administration where applicable, but Transit Auto does not provide any additional warranty for third-party-branded products unless expressly stated in writing or required by applicable law. 

Product-specific warranty information, if any, may be displayed on the applicable product page, in product documentation, or in a written warranty statement provided with the product. Warranty coverage may vary by product, brand, product category, and intended use. 

Where a product-specific warranty is displayed or provided, that warranty applies only according to its stated terms, limitations, exclusions, claim procedures, and duration, subject to any mandatory rights that cannot be excluded under applicable law. 

Subject to the foregoing, and to the maximum extent permitted by applicable law, Transit Auto disclaims all warranties, representations, and conditions of any kind, whether express, implied, statutory, or otherwise, except for any written warranty expressly applicable to a product, any warranty provided by Transit Auto as brand owner or warranty provider for brands owned or controlled by Transit Auto, any third-party manufacturer warranty expressly applicable to a product, and any warranty that cannot be excluded under applicable law. 

Some automotive replacement parts are wear items, maintenance items, or consumable-type parts because they are designed to be used, worn, depleted, serviced, or replaced over time during normal vehicle operation. These may include, without limitation, brake pads, brake shoes, brake rotors, filters, wiper blades, fluids, belts, bulbs, and similar maintenance or wear-related parts. 

To the maximum extent permitted by applicable law, normal wear and tear, routine maintenance, and the replacement of parts resulting from normal maintenance or expected wear do not, by themselves, constitute a product defect or breach of warranty. A product is not defective solely because it has worn down, reached the end of its expected service life, or requires replacement after normal use. 

The expected service life of a wear item may vary depending on vehicle condition, driving conditions, driving habits, installation, maintenance, load, environment, corrosion, contamination, heat, vehicle modifications, product grade, and whether the product is used within the manufacturer’s or brand owner’s specifications. 

Transit Auto is not responsible for claims, costs, losses, or damages arising from normal wear, misuse, abuse, neglect, improper storage, improper handling, improper installation, incorrect product selection, vehicle modification, non-compliance with laws, codes, manufacturer instructions, brand instructions, bedding-in procedures, or use of a product for an unintended or prohibited purpose, to the maximum extent permitted by applicable law. 

23. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Transit Auto and its directors, officers, employees, contractors, partners, affiliates, related companies, suppliers, service providers, agents, successors, and assigns from and against any claim, demand, action, suit, proceeding, liability, loss, damage, cost, or expense, including reasonable legal fees, arising out of or related to your use of the Website; your purchase, selection, installation, possession, resale, or use of products; your breach of these Terms and Conditions; your violation of any law or third-party right; your User Content or User Communications; your account activity; your misuse of promotions, returns, warranties, chargebacks, or other Website features; or any fraudulent, unlawful, unauthorized, or abusive conduct by you or through your account. 

24. Revisions to these Terms and Conditions

Transit Auto may revise these Terms and Conditions at any time by posting an updated version on the Website or by providing notice in another manner permitted by law. 

The updated Terms and Conditions will apply to your use of the Website after they are posted or otherwise made available, unless otherwise required by applicable law. 

You are responsible for reviewing these Terms and Conditions periodically. Your continued use of the Website after any update constitutes your acceptance of the updated Terms and Conditions. 

Certain provisions may be supplemented, replaced, or modified by additional legal notices, policies, product terms, promotion rules, checkout terms, or other terms made available on particular pages of the Website. 

25. Applicable Law

These Terms and Conditions, your use of the Website, and all related matters are governed by the laws of the Province of Québec and the applicable federal laws of Canada, without regard to conflict-of-laws rules that would lead to the application of any other laws. 

Subject to any mandatory consumer protection rights that may apply, any dispute arising out of or relating to these Terms and Conditions, the Website, or any related matter shall be brought before the courts having jurisdiction in the judicial district of Lévis, Québec, Canada. 

These Terms and Conditions, together with any other legal notices, policies, and terms posted on the Website, including the Privacy Policy, form the entire agreement between you and Transit Auto regarding your use of the Website, except as otherwise expressly stated. 

26. Currency, Pricing, Taxes and Fees

All prices displayed on the Website are in Canadian dollars (CAD), unless otherwise clearly stated. 

Applicable federal and provincial sales taxes, shipping fees, and other charges will be displayed before you confirm your order. Transit Auto will charge and collect applicable sales taxes based on the shipping destination of the order in accordance with Canadian tax laws. 

Transit Auto aims to ensure that prices and mandatory charges are presented clearly before checkout. If an error affects the price, availability, shipping charge, tax calculation, or other material order information, Transit Auto may correct the error and, where required, give you the opportunity to accept the corrected order or cancel it. 

Promotions, discounts, clearance pricing, coupon codes, limited-time offers, and special pricing may be subject to additional terms, eligibility criteria, exclusions, quantity limits, inventory availability, geographic restrictions, and start and end dates. Transit Auto may modify, suspend, cancel, or refuse any promotion, discount, coupon code, or special offer where permitted by law, including in cases of error, misuse, fraud, technical issues, inventory limitations, or unintended application. 

In the event of a refund, the refund will be issued in Canadian dollars using the original payment method where possible. Transit Auto is not responsible for currency conversion differences, exchange-rate fluctuations, or fees charged by your financial institution. 

27. Fitment Responsibility and Labour Waiver

The Website may provide compatibility tools, search filters, product information, fitment notes, interchange information, or Year/Make/Model lookup features to assist with product selection. These tools and features are provided for convenience only and do not constitute a guarantee of fitment, compatibility, performance, or suitability. 

It is your responsibility to verify that the product is appropriate for your specific vehicle before purchase and installation, including by confirming the part number, specifications, fitment notes, and, where appropriate, compatibility with your Vehicle Identification Number (VIN). 

Vehicle variations, production changes, trims, engines, sub-models, regional specifications, previous repairs, aftermarket modifications, lifted or lowered suspension, and other factors may affect compatibility. 

For wear items, maintenance items, and consumable-type replacement parts, including brake components, filters, belts, bulbs, fluids, and wiper blades, performance and service life may vary significantly depending on vehicle condition, installation quality, driving conditions, maintenance, product selection, vehicle modifications, and use. To the maximum extent permitted by applicable law, Transit Auto is not responsible for reduced service life, noise, vibration, uneven wear, premature wear, or replacement needs caused by incorrect fitment, improper installation, failure to follow manufacturer or brand-owner procedures, vehicle condition, seized or defective related components, contamination, corrosion, overheating, aggressive use, towing, racing, off-road use, or other conditions outside Transit Auto’s control. 

To the maximum extent permitted by applicable law, Transit Auto is not responsible for labour costs, diagnostic charges, shop time, towing charges, rental vehicle costs, loss of use, installation costs, removal costs, reinstallation costs, programming costs, calibration costs, or damage to other vehicle components arising from incorrect product selection, incorrect fitment, improper installation, defective installation, misuse, vehicle modification, or installation of a product that is not compatible with the vehicle. 

Nothing in this section limits any mandatory rights or remedies that may apply under applicable consumer protection laws. 

28. Website Changes and Termination

Transit Auto reserves the right, at any time and from time to time, to modify, suspend, restrict, or discontinue the Website or any part of it, temporarily or permanently, with or without notice and without liability, to the maximum extent permitted by applicable law. 

Transit Auto may change, remove, update, suspend, or discontinue any Content, product listing, product information, feature, functionality, service, account tool, promotion, or Website component at any time, to the maximum extent permitted by applicable law. 

Your only remedy with respect to dissatisfaction with the Website, Content, policies, practices, or changes to the Website is to stop using the Website, subject to any mandatory rights or remedies that may apply under applicable law. 

29. Account Termination

You may stop using your account at any time. Transit Auto may suspend, restrict, or terminate your account or your use of the Website at any time, for any reason or no reason, with or without notice and without liability, to the maximum extent permitted by applicable law. 

Transit Auto may suspend, restrict, or terminate an account in cases of suspected fraud, unauthorized access, inaccurate information, misuse, abuse, security risk, violation of these Terms and Conditions, chargeback abuse, return abuse, promotional abuse, or other irregular activity. 

You remain responsible for all orders placed, charges incurred, obligations created, and activity occurring through your account before termination, to the maximum extent permitted by applicable law. 

Account termination does not affect any rights or obligations that arose before termination, including payment obligations, indemnification obligations, intellectual property rights, limitation of liability provisions, warranty limitations, dispute provisions, or any mandatory consumer rights or already-paid orders to the extent protected by applicable law. 

30. Language

These Terms and Conditions are available in English and French. 

For Québec consumers and other persons entitled to receive a French version under applicable Québec language laws, the French version of these Terms and Conditions is made available before the person chooses to be bound by the English version, where required by law. 

Where permitted by law, you may choose to be bound by the English version after having had the opportunity to review the French version. 

In the event of any inconsistency between the English and French versions, the version that provides the consumer with the protection required by applicable Québec consumer protection laws will prevail.
